HMV Agents Membership Terms, and Conditions

You must read and agree the Terms and Conditions stated below in order to become a member. 

Then Click on button at the bottom of the page.

 

1. What is HMV Agent?

 

a)      We are an online communication network designed enhance the marketing abilities of our members.

b)      Our members are provided with a system of infrastructure that is superior to any other Internet marketing partnership.

c)       This system was created because the public has a negative opinion about real estate professionals and this gives agents the power to give things to the public and build lasting relationships.

d)      More and more consumers (over 75%) are using the Internet to search for homes. We decided that other marketing partnerships are one-dimensional.

 

This network consists of 3 web sites.

 

e)       For potential homebuyers and home sellers called HouseMarketValues.net. Where the public goes to and fills out any one of the forms that the results of are e-mailed to the HMV Agent that subscribes to the area they live in.

f)        An exclusive site for members only called HMVagent.com with tools to help follow up and generate leads for our members along with links to areas of the Network that are hidden from the public.

g)      A web site that sells web hosting and other internet tools called HMVdomains.com

 

Please read about each one and what they can do for you in detail in the next 3 sections below.

 

2. HouseMarketValues.com

 

a)       HomesForSale: This network features ads of homes for sale by owners an builders By allowing homeowners to post free ads we create a forum to draw in the public and generate leads.

 

The following are forms that visitors fill out to let the HMV Agent (Area Service Administrator) know that they intend to enter the real estate market. Results of the form are e-mailed to the agent who services the zip code area:

 

b)      FreeCMAforOwners: Homeowners that intend to sell within the next 24 months fill out this form to get a free evaluation.

c)       FreeCMAforBuyers: Buyers that intend to purchase a home in the near future fill out this form to get the value of properties they are considering purchasing. The results of the form only go to one agent in the zip code area the client lives in to prevent more than one agent from getting the same lead. Plus the client may have a home to sell. This also gives the agent a chance to get a referral if the client intends to move far away.

d)       MortgagePrequalification: Visitors that may want to prequalify for a loan fill out this form. If the agent service provider is also a mortgage broker they can service the form submitter or refer the lead to any qualified mortgage broker of the HMV Agent’s choice.

e)      ListForFree: This form is for homeowners that wish to put a free ad on our network.

              I.      As an HMV agent you will be known as the Area Service Administrator. It will be your duty to list homeowners request to post a free ad on our network.

            II.      You agree not to charge to post listings on our network.

         III.      You may ask homeowners to grant the exclusive right of sale to you if the homeowner decides to give that right to any real estate agent in exchange for a free virtual tour if you are authorized for virtual tours. (Void where prohibited by law) Terms must be specified in writting prior to making such an arrangement for you own protection. Further details posted on HMVagent.com.

          IV.      You also agree to follow the laws of your state and local governments regarding advertising.

            V.      Agent members may post ads for new construction and list yourself as the contact as long as you post your name, telephone #, and name of office or any other contact information required by the laws of your state of license.

          VI.      Agents will be responsible for giving the listings the secondary set of ID#’s. The primary will be generated by the system automatically.

        VII.      You may not post any ads that are offensive and/or discriminatory towards any group or individual.

   VIII.      You may post up to a maximum of 50 ads in your areas web pages per zip code.

 

                                                          

        

f)        Virtual tours: We will have the ability to put in links to virtual tours in the near future.

 

  1. You must be preauthorized.
  2. You must purchase the items, software, and/or hosting that will be required.
  3. You may give a homeowner a free virtual tour if they agree to give you an exclusive right of sale if they opt to give the "exclusive right of sale" to any real estate professional. If the homeowner decides to give such terms to any agent. In other words they can sell on their own but if the homeowner wants to enter an "exclusive right of sale" agreement with a real estate agent then they agree to give it to you for specified terms before making such an agreement. (Void if prohibited by law.)
  4. Requirements for the virtual tour will be placed on HMVagent.com in the near future.
  5. Agreement for any terms of conditions must be agreed upon before accepting the owner's ad.

 

 

4. HMVagent.com

 

This web site is for the support of our Agent Members. It is designed to provide agents with tools and resources to generate and follow through on leads. We have ads that can be downloaded and reproduced for pennies apiece. Far less than ads that real estate agents have printed with a better response because the public does not want to deal with real estate agents unless they have to.

The site will consist primarily of the following:

a)      Door hanger downloads: One of the best ways to get peoples attention is a door hanger on their doorknob to greet them when they get home.

b)      Post card downloads: Template for postcards for ads that can be mailed out if you choose. Great for gated areas or rental complexes.

c)       Homeowner tips downloads: Articles to e-mail people agents have made contact with to keep their name in front of them as much as needed to keep good communications open.

d)      Agents’ referral: Link to form for sending a referral to another HMV Agent.

e)      Other agent links: The main purpose of this site is to keep certain links and confidential information away from visitors.

 

5. HMVdomains.com

 

            This web site sells web hosting and other Internet tools at special low rates. This web site was created as a benefit to our members to provide them with additional marketing tools. Web sites that can be set up online without having to know programming the way you want it. Check out our low price on domain registrations.

 

6. Area Service Administrator

 

            By subscribing to become an HMV Agent you are know to the Public as the Area Service Administrator for the area you subscribe to. In addition to HMV Agent the term used by the management of House Market Values Network you will also be referred to as Area Service Administrator.

 

7. Internet Based Evaluation

 

            We use this term due to the fact that most real estate agents are members of organizations that provide them with means to create and e-mail a home valuation. If not available in your area more than likely it will be soon.

 

8. Membership Relationship

 

a)      By subscribing to be an HMV Agent you are becoming a franchise of House Market Values Network.

b)      You have the right to use our brand name in your zip code territory. see section 15 for restrictions.

c)      You understand the you being a franchise is contingent upon following the Terms and Conditions.

 

9. Who can be members?

 

a)      Licensed real estate agents and brokers in the area they sign up in.

b)      Can be an individual, team, or an office.

c)       The official member is the individual listed on the method of payment.

 

 

10. Membership Transfers

 

a)      Members may not transfer their membership to another individual.

b)      The individual on the method of payment is listed as the primary member.

c)      Once the primary member unsubscribe or looses their membership for any reason it becomes available to the next person who claims it as soon as the current member is programmed out of the system.

 

11. Refund Policy

 

a)      Any subscription fees collected are non-refundable. The agent pays for the specified time and is bound to that amount of time. When you sign up we have committed to providing resources to expand the network to provide you.

b)      Memberships begin as soon as the method of payment is submitted. However it may take up to a week to get new agents programmed into the system. As soon as the agent is programmed in they will be sent an e-mail and their termination date for non-payment or unsubscribing will be credited for days between signing up and being logged in the system.

c)       Members that wish to terminate their membership subscription must do so before their next billing date to avoid being charged. If they terminate after the billing date it is non-refundable.

d)      Any individual who’s membership has been terminated for reasons mentioned in the “Reasons For Immediate Termination Of Membership” section below will not be refunded any fund paid for the term of the subscription they have paid for.

 

12. Unsubscribe

 

a)      To Unsubscribe e-mail Agent@HouseMarketValues.net  The subject line unsubscribe.

b)      Subscription will end on the next date of billing.

c)       Once any funds are paid in advance you are bound by that time period. So you can only unsubscribe on your next date of billing and you must submit your request to unsubscribe within 3 business days before your next date of billing.

d)     Subscriptions are paid for in advance and are automatically renewed until you unsubscribe.When You  unsubscribe Your membership will end at the period you have paid for and autopayment will stop. You are still obligated to serve your area until the end of the period you are billed for. For example if you sign at the yearly rate and you decide to unsubscribe after 6 months than you agree to still be entitled to 6 more months. If you refuse to give patrons the service that you agreed to than you are violating the terms and conditions of HMV Agent subscription. You will be terminated and you will not be compensated for any time left since you have violated the Terms and COnditions of being a HMV Agent member.

 

13. Lead Generation

 

            Our system is designed to be a cooperative system. It is a partnership between House Market Values Network, the agents, and homeowners. We charge basically for the infrastructure we have put in place.

Some others charge more money for one month for their lowest priced territory with far less features than we do for a whole year. You can take a fraction of the savings and use it to generate traffic to the web site and generate leads.

So our low rates give you the opportunity to target based on your needs. If you need a particular type of home in a certain neighborhood with certain criteria you can target such homes.

Leads are generated by the following:

a)      Search engine submission: We have submitted our web site to all the major search engines. As the site grows it will move up higher and higher. However this is a competitive category. We expect to move up because our domain name has popular keywords with in it.

b)      Opt in e-mail: We buy lists of e-mail addresses of individuals who have opted in to receive such information that we provide. As we build our Homes For Sale pages more and more people will be logging on to see what is for sale.

c)       FSBO Free ads: The main thing that is unique about our system is that we cooperate with homeowners. We give them free tools to market their home and they help promote the network by:

                                                               i.      Purchasing an optional yard sign with the listing ID #.

                                                             ii.      Using their free ad in their own ads to give buyers additional information that might be to long for a newspaper ad. They can use our shortened domain name HMVN.com in their newspaper ads along with the listing ID #.

d)     To get leads Agent Members should:

                                                               i.      Give out door hangers.

                                                             ii.      Send out mail outs.

                                                            iii.      Get any For Sale By Owners that will not list with you an ad on House Market Values Network and purchase the Yard Sign.

e)      Disclaimer: We do not promise nor guarantee that you will get any particular number of leads or any at all. We are a system of infrastructure designed to be a tool.

 

We will do what ever we can to promote this network along with our members.

 

14. Lead Verification

 

When a HMV Agent receives the information from one of the submitted forms they are responsible for verifying that the information is from a legitimate source and is not from someone submitting false information.

Any information you feel is incomplete you may ask the client via e-mail, mail, or telephone if # is given to submit additional information or refill the form at HouseMarketValues.net with more complete information.

To verify leads just simply look for the following information sources on the Internet:  

 

a)      Reverse directory: Web sit that features a place where you can cross-reference listed information by Name, address, or telephone number. (Searchbug.com)

b)      County Property Appraiser web sites: You can match a name to an address by going to your local county property appraiser web site. Mostly all counties have one.

c)       County Mortgage Records: More information about property owners can be found in public records. Mortgages are public records.

d)      State Real Estate Agent License Info: It is good to check to see if the person submitting the form is a real estate agent. Even though they answer no they may be an agent or someone in their household is. You may trace an e-mail to false information given by a real estate agent that is curious about what you are doing.

 

Contact your local county government to find out where to find them online.

 

15. Use of House Market Values Network TM  Brand Name For Promotion Purposes

 

a)      You as an HMV Agent member agree that as a franchise of our network you agree to only use the format of advertising that is pre-approved by our staff and are stored as downloads at HMVagents.com.

b)      HMV Agent members may authorize home owners they list on our Network to use in any ad such as newspaper, magazine ads, TV commercials or any other form of advertising the following

                                                               i.      HouseMarketValues.net

                                                             ii.      The shortened domain name HMVN.com used to save space and goes to HouseMarketValues.net home page.

                                                            iii.      Listing ID#

                                                            iv.      Encourage Homeowners to purchase the For Sale Sign from HouseMarketValues.net

c)       You may not mix your personal name with our brand name for ads. Only in e-mails to patrons that have filled out the forms and you make contact with on behalf of HouseMarketValues.net. Use of HMV Agent’s personal name is described in the section below.

 

16. Use of HMV Agent’s personal name and information

 

            The main purpose of this network is to provide the public with a brand name they can use anywhere and get results e-mailed to them. Patrons who come to our site give us the lead and it automatically gets regenerated to you the HMV Agent that is the Area Service Administrator for their zip code.

            You may use your personal name for the following situations in regard to House Market Values Network:

a)      When e-mailing results to patrons of forms filled out at HouseMarketValues.net or any other contact, mail, telephone, or personal visit as per most state laws you must include your name, office name, and method of contact.

b)      When advertising you may only use pre-approved formats posted at HMVagent.com.

c)       You only use your name, and method of contact in the Homes For Sale Page for new construction. Only the Homeowner’s name may be used as method of contact for their own homes.

d)      When making contact with patrons it should start out with disclosing your name, office, and method of contact and the begging of the letter or opening statement should include “the folks at HouseMarketValues.net have asked me to fulfill your request”.

 

17. Methods of Contact

 

            We prefer that patrons whom have request information by submitting forms be contacted by e-mail however in certain situations it may be necessary or convenient for the HMV Agent that is the Area Service Administrator to contact patrons by:

a)      E-mail

b)      Personal Visit

c)       Mail

d)      Telephone if # is given

e)      Fax if # is given

Method of contact is at the discretion of the HMV Agent

18. Down Time

 

We intend to keep this network running at all times. Our hosting assures us of up time of  over 99.9%. We will not be responsible for circumstances beyond our control. You understand that you are not entitled to any refund or discount for any down come this network may, although unlikely to occur due to our host or the system being overloaded by request.

            As the system grows we will up the amount of power we have on our servers. We will monitor the system best we can. If you notice at anytime you or someone you know is unable to get us online please e-mail us at Agent@HouseMarketValues.net to let us know and we will address the situation ASAP.

 

19. Listing Disclaimer Forms

 

            You agree as an HMV Agent to have all homeowners that post an ad on House Market Values Network sign a disclaimer you will download from HMVagent.com to protect yourself, your broker, and us.

            The form will state that the homeowner understands that they are posting an ad on our network, and they are in no brokerage relationship of any kind with you the agent, your broker, or House Market Values Network.

            In addition to that there will be information that the HMV Agent fills in that will be entered into the ad when it is posted. This information is all the information usually required to list them on MLS so you can have paperwork ready in case the homeowner decides to enter a fiduciary relationship with you and your broker.

 

20. Limitations of Liability

 

            As a franchise you assume all liabilities for actions you initiate as a member. Every action by House Market Values Network is constructed with the intention of no harm to anyone.

 

We make no claim to guarantee anything including and not limited to:

 

a)      Accuracy of estimates given by our members.

b)      Anything to do with the sale of any home listed on or serviced by those who submit to any feature provided by this Network.

c)       We provide the infrastructure. Members are liable for information submitted as deemed by law and understand that they are responsible and can be removed for violation of Terms and Conditions.

d)      We intend to remove any member that does any action to cause any problems for this network and/or the general public.

e)  This network is not responsible for enforcement of any deals made by our members with members of the public or other members of this network.

 

21. Reasons For Immediate Termination Of Membership

 

            Your membership may be terminated at any time for reasons stated below for actions by the HMV Agent or any individual who acts on behalf of the HMV Agent.

 

a)      Any activity deemed unlawful by Local, State, and/or Federal law involving the use of any part of this network.

b)      Sending out unauthorized Spam or making cold calls in the name of this network

c)      Being involved in any criminal investigation where usage of any part of this Network is under question.

d)      Any act consider discriminatory toward any group or individual. Refusing to post ads for individuals based on Race, Religion, Sexual Orientation, Gender and/or any other discrimination that prevents members of the public an equal opportunity to services promised by HMV Agent members.

e)      Posting listings from your office that are considered property of the office where a real estate agent is required to be method of contact. Only new construction ads can list a real estate agent as method of contact. Owners that are licensed Real Estate Agents or Brokers must identify themselves as owner/agent when selling their own property.

f)       Continued complaints from the public 30 days after the management and/or staff of House Market Values Network issue a written letter of warning.

g)      If it becomes apparent to the management and/or staff of this Network that you no longer are an active real estate agent your membership can be terminated. For members who subscribe to more than 1 month will be issued a warning to become active within 30 calendar days to activate their license.

h)      Failure to follow “Use of House Market Values
